Terms of Service

By accessing or using PhotoShare (the "Service"), you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Who We Are

PhotoShare is a private photo delivery service that allows photographers and creators to share password-optional galleries with clients, friends, family, or businesses. It is not a social network, a public file host, or a content distribution platform.

2. Acceptable Use

You agree to use the Service only for its intended purpose: sharing photo galleries with people you have a legitimate relationship with. You must not use the Service to:

• Upload, store, or distribute content you do not own or do not have explicit permission to share.
• Host content on behalf of third parties in exchange for payment or compensation (i.e. CDN or reseller use).
• Use the Service as a website host, asset server, or delivery network for any application or web property.
• Hotlink directly to original files for embedding in external websites or applications.
• Distribute, scrape, or programmatically access content for indexing, training AI models, or any other automated purpose.
• Upload content that is illegal, harmful, defamatory, or that violates the rights of any person.
• Share or expose access links in a way that makes galleries publicly discoverable beyond the intended recipients.
• Attempt to circumvent storage limits, access controls, or any other technical restriction of the Service.

3. Content Ownership & Rights

You retain all rights to content you upload. By uploading content to the Service, you grant PhotoShare the limited right to store, process, and serve that content for the purpose of operating the Service (e.g. generating thumbnails or delivering files to your recipients). We do not claim ownership over your content and will not use it for any other purpose.

You represent and warrant that you own, or have obtained all necessary licences and permissions for, every piece of content you upload — including but not limited to copyright, model releases, and property releases where applicable.

4. Prohibited Content

You may not upload content that:

• Depicts or promotes illegal activity of any kind.
• Contains sexually explicit material involving minors (CSAM) — violations will be reported to the appropriate authorities immediately.
• Is defamatory, harassing, threatening, or violates any person's privacy or publicity rights.
• Infringes any third-party intellectual property right without authorisation.
• Contains malware, viruses, or malicious code.

5. Plans, Payments & Refunds

Access to active gallery hosting requires a one-time payment for a fixed term. There are no subscriptions or recurring charges. Pricing is calculated based on your gallery's actual storage usage and chosen term.

All payments are processed securely by Stripe. We do not store payment card details. Payments are generally non-refundable once a gallery has been activated. If something went wrong technically on our end, contact us and we will make it right.

Galleries that are not renewed at the end of their term will enter a grace period before files are removed. Refer to the management page for your specific expiry date.

6. Service Availability

We aim for high availability but provide the Service on an "as is" basis without guarantees of uptime. Scheduled or emergency maintenance may temporarily interrupt access. We are not liable for any loss caused by service unavailability.

7. Termination

We reserve the right to suspend or terminate any gallery or account that violates these Terms, at our sole discretion and without prior notice. Content that violates these Terms may be removed immediately.

8. Limitation of Liability

To the fullest extent permitted by law, PhotoShare and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — the Service, including loss of content, revenue, or data. Our aggregate liability for any claim shall not exceed the amount you paid for the affected gallery term.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
